I'm building a house and have few provisional sum items in the contract.
In the contract, I have the the following clause: Any adjustment to the contract price for a prime cost item or a provisional sum item is due and payable with the progress payment in which the amount for that item is included.
There are items that the builder should have claimed during the frame and enclosed stage, but never did. Now, months later, in the practical completion stage payment he is trying to claim for items that were supposed to be claimed long long time ago. I feel, if he didn't claim during the stage the expense occurred, he is not entitled to claim it now, months later, but not sure.. opinions?
