Browse Forums General Discussion 1 Oct 16, 2008 12:18 pm we are currently first home owners and we are about to get the ok to start building., but we have a problem. There is large amounts of soil being dumped on our land, from people and builders doing there landscaping and paving ect...
No one seem to own up to it. It is unfair that we have to fork out money to remove other peoples soil. The council can't help us, they told us to contact the land seller. The land seller can't doing nothing about or not willing to do anyting about it. Any suggestions on what we can do as a builder and our rights. Put up barricades to stop vehicals from accessing your property (rocks, posts etc) Take photos, look for possible evidence of ownership Report it to the police, and submit before photos if available and what it looks like now Ask council if possible for list of people that have already brought land close by, esp your neighbours (you can tell council you want to serve a fencing notice on them) With this list, look at recently cut blocks for simular soil (long shot) Talk to potential neighbours and people driving through if they have seen anything. This is a good way of getting to know your new neighbours. i think my new neighbours are the one doing the dumping, but have no evidence. and by the way wat is a fencing notice?? ive got some photos of all the soil dumping...that i will post up if i report it to the police, what can they do? You might be able to claim on insurance for starters....so report it to the police. The fencing notice (in SA at least) is something you serve on your new neighbour. It's a legal document you need to serve to claim 1/2 the cost of your new fence from your neighbour. Ask for the contamination report which I doubt they have.
