Browse Forums General Discussion 1 Jul 18, 2021 11:10 am Hi everyone, hoping to get some advice prior to starting this process - i have no idea of the implications to myself so want to make sure I go in with my eyes open. I have bought a property in Kingston council VIC, that has a huge tree in the front corner of the property. This is easily a significant tree so requires a permit for removal. This tree is hard on the fence line and is pushing forward the brick front fence, which is leaning towards the footpath. This is a hazard and needs to be actioned. The kicker is there is also a stormwater easement (E-1) that runs through my property and this tree is over that. I have some suspicion that the tree has damaged the easement based on the grass growth on the nature strip. So my questions are as follows: - is the damage to front fence a reason to remove a significant tree? Or would I be told to just remove the current fence and build around it so to speak. - as the tree is over an easement on private property, is the cost of the removal paid for by myself or the council? - in the event this tree has damaged the stormwater pipes, am I liable for the cost of fixing this? I have owned the property for less than a year and this tree would be decades old. Thanks in advance to whoever may be able to help with some of the above. Not sure if relevant but I am one of two units on the block which was subdivided in the 90’s, the tree may precede this date but I cannot prove that. This tree was here when we bought the house. Our council is also Kingston. I am wondering what the outcome of this was. Did the council allow you to remove the tree and if so who paid?
