VCAT question - Do you need to go through a lawyer?

Do you need to go through a lawyer in order to take your builder to VCAT?
No, you don't need a lawyer. It's pretty informal. Either side can have a lawyer, but even if they win you don't pay his costs.

Nope. Just go to the website of VCAT and apply online. Make sure to check the VCAT site to see whether or not your matter should first be referred to the DBDRV(Domestic Building Dispute Resolution Victoria) prior to filing with the VCAT.

Lawyers aren’t actually required for VCAT proceedings. This includes First Directions Hearing and the Final Hearing, if the matter ever reaches that point.


However, if you want to manage your risk and get advice then getting a specialist construction lawyer to assist you is probably the way to go. Also, depending on the value of the dispute, your builder would most likely be represented by a lawyer, so you should probably consider being legally represented by one, yourself.
