We are building side by side townhouses with a common wall. This party wall is required to be fire rated and built according to certain materials and specifications. It has not been .
What sort of consultant would be best to employ to provide a report which would hold up at VCAT?
Should this have been picked up by the Building Surveyor?

You'll need a fire engineer. The rules of engagement are quite simple
The builder needs to follow the construction Codes NCC (Cookbook) and the Building surveyor can certify it as compliant.
If the builder does something different then it is non compliant and will need to be rectified/certified by an engineer as an alternate solution. Rarely do they pull walls down they will add to it and it needs to be signed off as compliant/equivalent
