The land owners have lodged their application and recently received their CDC approval but their construction has not started yet. We checked their construction plans and found they have a big staircase window (about 1.2m wide) less than 2m away from our boundary overlooking our property. They also have a bedroom window on the second floor which is 1.2m height without any privacy screen( the window starts 1.3m above floor level). Their certifier is their friend so we are not sure if their fully followed CDC requirements. Just checking if anyone here knows about complying developments rules applicable to windows and if the windows size are within what is allowed. Thanks. I am not sure how it works for CDC but for building permits in Vic the stairs needn’t be screened or obscured as they are not a living or habitable area. Bedroom windows needs to be obscured if writhing the overlooking restriction. I am in a difficult situation.
