He did a bad job and we had to go to Qbcc and they took a look at his work and said it’s a tolerance. This builder refused to do variations and he changed the plans on us and we are expected to live with these changes. He breached the legislation but all he got was a warning. He demanded money for a stage payment that he hadn’t even finished. Refused to put in our stone bath. Abandoned the building site and we couldn’t get him to come back and we had to project most of the final work ourselves like tiling and cabinetry. No commencement notice given started 2 months late. Used a 2013 contract in 2020 Refused to build steps that are on the plans. This builder was nightmare. Has anyone gone through this with their builder if so what was the outcome. I’m withholding the final payment. But apparently I’m now breaching the contract if I don’t pay him. 🤬 Re: Bad builder 2Apr 28, 2021 9:15 am Check your contract for the agreed proceedure to notify the builder you are withholding the stage payment due to the job not being complete based on the agreed plan and workmanship to Australian standards. I doubt the Building commission will do anything other than slap him on the wrist, besides they would be swamped with other complaints The courts aren't interested either, besides you need money to get justice most find by the time homeowners finish they are emotionally and financially bankrupt and had enough. Sorry this saga doesn't end you need to find someone to fix and finish the build. But apparently I’m now breaching the contract if I don’t pay him. 🤬 If that was me id write a letter to him for breaching duty of of completing a house with no defects you must pull your breach first and hire a good lawyer, unfortunately these days its the only thing they understand when it comes from a lawyer they know they can get away with it till it becomes legal. Go and see a lawyer dont wait for him to come after you for breaching stage payment. Take photos of everything. Good luck i amgoing through same thing. But long story.
