We had a renovation that finished mid-2015, soon after completion our builder requested us to sign the occupation certificate application but we never received our OC. We weren't aware of the necessity for this form and now nearly 6 years on we still have no OC. The builder missed an inspection, the Waterproofing inspection. He swears he booked it but the certifier didn't show up as they were busy they continued on without it. The certifier says its nothing to do with him and the builder is saying it's all the certifier's fault. Meanwhile, we are stuck with no OC. How can we get this sorted. Will they have to re-inspect the waterproofing? In the meantime the balcony has leaked twice into our lounge, the builder has repaired it twice but I'm still not convinced it's repaired. The roof is damaged and needs new gyprock. So can I make the builder do this as it's less than 6 years since completion? So annoyed. Like ⋅ Add a comment ⋅ Pin to Ideaboard ⋅ Thats a terrible story. Waterproofing now forms part of the 6 year warranty so you should be able to make them repair it. Sounds like you may need some legal advice to see if it applied at the time of your build. If you want a good cost effective construction lawyer to help you PM me There is also a way that you can get what is effectively an OC through your council if you cant sort one out with the builder. Council can issue you with a certificate confirming that there will be no orders for demolition so you can at least sell it if you need too.
