Given he was the Owner then the Council is correct in stating that the bond will be repaid to him. You need to check with your local Council on the Owner's obligations in regards soakwells and crossovers. However if it was agreed that you'd do this you're likely to be out of luck. When you undertake any construction you pay a verge bond to the council to cover any damage that may occur during construction. The developer may have had to pay this if he had to undertake works to gain subdivision approval. It has nothing to do with the driveway and only pertains to the council property in front of the house. Really he should have claimed it back once he completed his work and you should have had to apply for one with your building licence. The council will give you a payment for the crossover if you have built it to their specifications as this is something they would normally do so they give you a subsidy. Again that only relates to the crossover on council property. Verge bonds are only refunded to the person who originally paid it so if the developer paid it and you never got anything in writing it doesn't look like you will get that money.
