There is no easement on my driveway, and the neighbour did not ask my permission. Is my neighbour legally allowed to bury his cables under my driveway without persmission? What are my rights? Yes, I don't like my neighbour and his builder was constantly using my driveway without asking, so I'm pretty annoyed. Like ⋅ Add a comment ⋅ Pin to Ideaboard ⋅ If he has indeed accessed your land for his cable installtion then that would be wrong without your consent so I'd discuss it with your council and power supplier but I suspect the question that will be generated is "How does this adversely affect you?" Did they restore the driveway surface to what it was previously? Have you noticed any subsidence where the cable is? What if I want to build a fence on my boundary, or a gate on my driveway, and a post has to be installed right were his cables are? Clearly that adversely affects me. I dont know If I will or not in the future, but I shouldnt be restricted based on him cables under my property, surely? Then if they are no help you could go the legal route which will potentially cost you thousands and maybe get you a win. A 6ft fence won't need to go deeper than that for posts - although your fencer might dig gingerly in that area! I want to build a bigger driveway (without a nature strip) than has been approved under my CDC. I’ve also had a DA approved to build a deck.
