I assume he dug under my driveway because he has a retaining wall between his house and the pit, and he didnt want to run the cable under or around the retaining wall. Start to charge him rent for having his needs on your property, or dig your driveway up "For Maintenance" and then tell him they have to be moved and get rid of them Re: Neighbour placed electricity cables under my driveway - 5Feb 19, 2021 9:01 am Fore2 chiggles No my driveway isnt sealed. Is it a shared pit, i.e. does it service more than one dwelling? Here in WA we have the "Green Dome" instead of a pit and they are normally the supply point for at least 2 houses and up to 4. Also is that portion of your driveway your land or is it the local council's land? The part of the driveway that he dug through is 100% owned by me, not him or the council. Re: Neighbour placed electricity cables under my driveway - 9Feb 19, 2021 7:43 pm chiggles My neighbour recently built and his electrician dug a trench under my driveway to place his electrical cables - see diagram attached (his cable in red). There is no easement on my driveway, and the neighbour did not ask my permission. Is my neighbour legally allowed to bury his cables under my driveway without persmission? What are my rights? Yes, I don't like my neighbour and his builder was constantly using my driveway without asking, so I'm pretty annoyed. Did they restore the driveway surface to what it was previously? Have you noticed any subsidence where the cable is? What if I want to build a fence on my boundary, or a gate on my driveway, and a post has to be installed right were his cables are? Clearly that adversely affects me. I dont know If I will or not in the future, but I shouldnt be restricted based on him cables under my property, surely? Re: Neighbour placed electricity cables under my driveway - 11Feb 20, 2021 9:25 am As I said, consult your council and your electricty supplier. Then if they are no help you could go the legal route which will potentially cost you thousands and maybe get you a win. Re: Neighbour placed electricity cables under my driveway - 12Feb 20, 2021 10:00 pm For what it's worth, electrical lead-ins are generally buried at least 600mm deep. A 6ft fence won't need to go deeper than that for posts - although your fencer might dig gingerly in that area! I want to build a bigger driveway (without a nature strip) than has been approved under my CDC. I’ve also had a DA approved to build a deck. It looks like I can do this… 0 4814 you need to make an application to your local council for this as they are the approval authority for driveways cheers Simeon 1 7098 |
