Hi,
We live in QLD. I am not much sure about the laws governing the cost shared for the neighborhood fence. My neighbour popped in a few months after we built and moved in. He asked for a share of the fence he already built before we moved in. But we didn't like his fence as it has too many holes in it and we didn't like the material it was built. So I told him we don't like the fence that was built and we are going to build another fence parallel in our property. He came back again in few weeks claiming we broke the law in not sharing the cost. I mentioned you never consulted me before you built the fence. Also, how do you expect me to pay you if we are going to build our own fence?
He mentioned he moved in first and he doesn't know who is going to move in. We are still supposed to pay for it. Is this argument valid?
He never tried to contact us although he knows we are building and our builders were on-site while he was doing his fence. He never bothered to contact us through any means to discuss and finally, after a few months, he is aksing the money? Do I still need to pay him if I have my own fence?
