Does the council own this or is it the home owner? So if it was damaged or blocked would the owner have to fix it or the council? Thanks in advance. I had an issue last year where the sewer pipe was blocked under the public footpath outside my boundary and impregnated by roots on my land. Long story short, I paid for my side to be fixed ($4k) and lucky Sydney Water fixed the rest at no cost to me or else I would of bared the cost of excavating the footpath. My memory is vague but at some point a few years ago the rules changed so home owners don't bare the cost of fixing pipes under a public footpath. I presume by drains that you are talking about a 90mm plastic pipe that takes water from your downpipes to the gutter? What if this pipe was damaged by trees in the nature strip that the council had planted many years ago? I'll probably just ring the council for a definitive answer but thanks for the reply.
