We live on a busy road and want to put a electric gate on our driveway to protect our children and give us some privacy. The neighbours house forms a large part of the boundry and the fencing contractor has suggested we anchor the gate into the brick wall of their house than runs down our driveway. The property is rented out and we have tried to contact the owner but they are overseas. I assume we need their permission but not sure what we can do if they are not contactable (their agent has just said she has emailed them and cant do anything else) I am not even sure who to ring to see what our legal obligations are. Any advice appreciated. Maybe I could accept the lock being on a pole on my wall, if you had a whole gate swinging to it. If the fenceman does these gates, he should know the law? The Fitzroy Legal Service Law Handbook 2005 refers to the Magistrates Court for handling disputes and contacting neighbours etc. If you're in Victoria, try your local library for a copy. Can you put your gatepost at the front of their house on your own land .... Get one of those gates that folds up - towards a post on your land..... hmm maybe they're not electric. Don't do anything until you get authorization form the Agent or a response that says something like you'll have to ask the owner. It's not that I would be hard to get on with but it would be easy to pull the bricks out with the weight of a gate. Why not just put a post in the ground next to the wall ? It's unusual for a house wall to be on a boundary so this isn't making sense to me. You will need the neighbours permission to do this, otherwise you will have to install a fence and gate on the actual boundary of the two properties, but if you are trying to save money by moving the gate forward and attaching to your front neighbours house so you can avoid putting in a fence, then don't do it, keep these things on your own property to avoid future problems. I certainly dont want to upset anyone or do the wrong thing. Our current gate is anchored to their wall but it is not automatic. We are looking into ways around using their wall. Waiting on another quote at the moment. The driveway is just wide enough to get my car down and be able to get out of the car which is why anchoring it to the wall seemed the best solution. My parents used to own a battleax property, and the driveway to their house was actually owned by the property in front of theirs, subject to a right of way easement. With your front neighbour's house forming part of the boundary, to me it seems like the driveway is actually their land subject to the easement Does sound fun, but swings are made for one.
