I wil follow this up myself with my contacts at QBSA but before I do can you PM me and advise who it was you spoke to? Also, was your builder registered/licenced? II spoke to a Craig in bsa again today and he said if I pay the contract out then put in complaint they would assess. I had a professional concrete repairer on site today he said **** job and ground 6-8mm sample section it was still powdery between aggregate and he wouldn't be able to guarantee that self levelling mix will bond to concrete. he left site and guess what another wet grinding machine coming in 2 weeks..maybe this one will tell them what they want to hear. So now we have gone down 11mm only 9 to go until we hit the reo!!!!!!!!!!!!!!!!!!!!!!!!!!!! The company i am going through is a BSA and HIA Member Fully Licensed and a project Builder in QLD & NSW. can anyone tell me if i flicked a stoneout from the slab should it be surrounded with brown dirt and when you keep probing more dirt comes out not concrete? The idea of identifying major problems, paying money anyway and *then* complaining seems utterly and completely ridiculous in every imaginable way. Building inspector, Davco (world wide adhesive company) My main person I want on site is a Structual engineer BUT as I am under this contract I must have permission for anyone to go on site and my request has been denied. Both parties are bound by the contract and I would doubt that one party can exclude the other from allowing any person, regardless of their expertise to visit the site with you.
You are an equal party to the contract so if the builder can bring their experts there, then so can you! What if your husband or brother was a structural engineer, would they be banned from the site? I don't think so. Perhaps ask the builder to show you the clause in the contract that actually prevents you from bringing a structural engineer on site. Did you sign a standard HIA contract? This is what I'm trying to understand, Fiona has said that she has asked for "permission" and has been denied under the contract. I can't see a circumstance where that can be allowed. Builda makes an excellent point about being "equal parties" you cannot have all your rights stripped just because you have entered into a contract....that defies basic contract law. Under a standard HIA contract this can't happen unless there has been some weird "special clause" added. Not sure what is in your contract and whether this apply nationally but this is what is written under the Domestic Building Contract Act 1995 - Division 3 Clause 19 sub-section (1) - Access to building site ' A builder must permit the building owner (or a person authorised by the building owner) to have reasonable access to the building site and to view any part of the building works.' The only restriction is ' A person who is excercising a right of access granted under sub-section (1) must not interfere with the carrying out of the building work' I can't see why the builder won't allow you to have independent inspection I've attached a copy of the Domestic Building Contracts Act 1995 which I got from the Victorian Building Commission website for you to take a look.
