Issue with pipe location - who should fix, us or plumber?

We're building a new pool and the first thing we did before work started on site was discuss the finished height so the excavation could be done correctly.

Here we are months later about to lay concrete around the pool (which is not yet finished - still needs to be lined and filled) and our concreter says some of the pipes from the pool are too high. He needs more clearance to be able to put the concrete over the top and finish in line with the edge of the pool.

I contacted the pool company and they claim it's because the ground was rocky so the plumber couldn't put them any lower.

However, they *always* knew what our finished height was going to be, before they ever started excavating (and we paid extra in excavation costs), and when the plumber came in nobody ever called us to say there was an issue - he just went ahead and laid the pipes.

Is it reasonable to expect the pool company/plumber to come back and rectify this? (For what it's worth, the concreter reckons it's a 10 min job for the plumber).

Yes it is and you should insist.
