Yep you would only use it if you were using the pool so if you don't use the pool over winter time then I wouldn't bother with it during those months.

If I was going for a spa again I would go for the pump heater for the spa. Once the spa is running the water cools quite quickly without a heater.

Your council will have separate regulations about pools and the distance they may be from side boundaries. It probably varies a bit, so check their website, or give them a call. :D
