Read the contract and stick to the terms, don't listen to what your manager tells you. Tell him that you agree for them to walk away but then you will come back with the lawyer and Fairtrading complaint and we will both see what happens next. Thanks for your suggestion. Have you read your building contract and do you understand the concept of practical completion and the procedures of final inspection? If so you will have you answers, if not then do it. Do not be bullied by the builder and if you can't handle it on your own then get a very good building consultant...

What if they didn't complete the defects? This is the issues I concern although the site manager claimed all defects are done. The site manger refused my request to have the pre-handover inspection on 22nd February after he said all defects done. He said he would put back the fences at my expenses ...

Some major defects are reported since last site inspection. My site manager emailed me that the major defects have been fixed and final payment must be paid before handover. Is it okay to make the final payment without a practical completion inspection and before handover?

The cooker is meant to sit 10mm above the bench height as per the installation instructions. People always want them to sit level however most upright cookers are meant to sit higher than the benchtop to minimise the potential for scorching of the top. Don't agree with you, chippy. The free standin...

your cupboards etc should have a height in your contract and the stove should meet it? And as for the sink - the template for the sink may not have existed and the builder cut to whatever they wanted? Check the bench heights and the template and go from there... We had builders that tried to tell u...
Thank you very much for your advice. I will check the bench heights and the template if available.

Hi Fingal77, Thanks for your response. I absolutely agree with you. My contract only stated the model number of the stove and sink, does not mention their height. I emailed to the Head of Construction Department. He said these are not defects and no action will be taken. It is just not your expectat...

Generally it is calculated as a deposit, and taken off the contracted price. This of course depends on your contract. Check the contract. Thanks for prompt response. I don't the tender fee as a deposit" on my contract.

I paid $1200 for a tender for building a new house. The tender is finalised and accepted. The construction has commenced. I am wondering if the tender fee should be refunded to me as I pay the construction fees. Thanks.

Thanks for your response. The freestanding cooker (model WFE914SB) comes with no legs so the builder uses one length long of kickboard for the cabinets and cooker so the cooker is higher than the benchtop. Is it a big job to make the cooker on the kickboard lower? Thanks
