Energex advised me they didn't receive the application until 30th. Our start date was a week after that. I've since followed up with Origin/Energex who tell me power should be onsite by tomorrow. I've been advised by my SS that due to there currently being no power at site, I need to cover the cost of a generator he's needed to bring in to keep the early build stages progressing. I submitted the completed connection request forms to Coral back in Sept, however Energex advised me yesterday they only received the connection request from Coral a couple of weeks ago (hence the reason it's not installed yet), so I'm finding it hard to understand why this is my cost. Has anyone else had a similar experience? That's what I thought but my sales consultant confused me Schedule 1, 6) states that practical completion must be reached xxx days after the building period commences. Clause 1 (interpretation) explicitly defines the term 'working days' however the term in Sch 1 is simply 'days'. So 'days' when taken to have its ordinary meaning, will include weekends and public holidays. The only way they can claim an extension of time for Xmas is if at the time the contract was signed, it couldn't have reasonably been foreseen that the build would continue though that period (clause 19). ie there have been delays which caused he build to run overtime. If your build starts in Oct for example, and you have a 150 day contract, well it would be reasonably foreseen that the build would run into the shutdown period and additional time extensions cannot be claimed on that basis. Sometimes easements are unused and 24cm is not all that much. Good luck.
