Browse Forums Building A New House 1 Apr 30, 2013 3:56 pm Hi All, I have received a formal approval from my bank to buy this piece of land in Kellyville Ridge which has a sunset date of December 2013. There are a few things that I am concerned about and need to know what you guys think. -the builder introduced me to the private developer and has asked for 6k payment/deposit at acceptance of the tender/project quotation. Is it normal to pay Pre Construction costs even before the land is registered? What is the land is not registered by the sunset date and I exercise my right to pull out of the contract. It will mean I am risking the 6k. -Is it safe to buy unregistered land with no DA approval. What kind of restrictions can the DA include once passed? Has any one been in a similar situation. Is this a house and land package? Typically the builder will ask for the deposits required before council approval of the building. The council will not look at your applicatin before the land is registered, so the building contract will stop at this point. Any deposits you pay to the builder are not refundable because they consider them to be for work they are doing in preparing surveys, designs and applications. If you do not want to pay the builder before land settlement then don't. Keep in mind any quotes your builder has given you up to now will change if you wait a few months though. The land is owned by a private developer who has some kind of agreement with the builder that they will sell the land only to someone nominated by the builder (casaview homes). I am not comfortable paying the builder till the land is registered but I have been told that is not an option. So if I want the offer I will have to pay the builder and take the risk. Another thing that bothers me is the Project Quotation has no time frame on it. I have been told verbally that casaview homes will honor the tender even if it taken more than 180 days to register.
