Yeah Deejay they did go with another builder, wouldn't say better but they are now finished and happy on what they've got. In saying this, my friends were waiting on their land to be registered and hadn't signed off on the final contract, they were only expired by 2 weeks when Rawson did that to them. Amanda - definitely stick to your guns as you did sign the final contract tender and agreed with the price that's stated, they can't just change pricing, but they can put in a post contract variation to extend the date, like Fowler Homes did with me. We signed up late last year. Since then the communication has been poor and it has been quite difficult to reach CLO. In our case the CLO left the company and the new CLO has not responded to my emails for over 4 weeks. The plans haven't been submitted to council yet. My neighbor who signed up with Clarendon around the same time as us, have already got their slab laid. So we have decided not to waste our time and money with Mojo. They have really been terrible at returning phones calls/emails etc. the delays have all been on their behalf as they seem terribly understaffed and unorganised. We have had our appoinments changes numerous times. I showed them loyalty through all their stuff arounds and then thay have tried this on us. i wont be recommending them so far on what i ahve seen. If you haven't already, make a timeline of when everything happened so you can easily show that this is THEIR fault not yours. Also if you have signed the contract with the old price, I really don't think they have a leg to stand on! Demand to speak to someone higher! Re: Mojo Homes expired tender 14Feb 21, 2017 11:54 am Rayges Wow......I'm building with Fowler Homes and without even asking they did a variation on my tender to extend the expiry date as there were some delays on my end and their end. Mind you, they extended it twice and never changed the contract price that I had signed off on. Was the delay at your end or theirs? Rawson did exactly the same thing with my friends and raised their contract price because it expired and they told Rawson that they would not pay the price rise and Rawson then said they would not build their house and let them walk.....couldn't believe it.......they let $400K slip by for a $30K price rise. These project builders are so busy that they don't care if they let people go. Good luck and choose your next step carefully. Similar to our situation, our tender is due to expire this month (180 day tender). Land registration took longer then expected, then settlement another 3 weeks, it added up. So I took the liberty of contacting my consultant and had tender re-dated from October, right before their price increase. So we have till end of April to go to site, which wont be a problem. Tell them you have a legally binding contract for a fixed price, and apart from where stipulated in the contract (e.g. provisional sum items) you won't be paying a cent more. If they argue, get a lawyer. If you don't want to proceed with them, tell them to give you a full refund of your deposit and you'll go elsewhere. Slimy..
