The responses I kept on getting was anything above or below the surface needs Gov't approval (be it local, state or fed). So they can tunnel or mine beneath you, planes can fly over etc. You may be given the opportunity to object and maybe even put forward an alternative but the benefit can be given to someone other than the owner without having to compensate them unless it actually affects your building (as in damages it) or they need to acquire your property. Am I touching on what you're problem may be or are you being affected by say an easement? From what you're saying there's no limit, except you need council approval.. But how deep until you need council approval? You can have the rocks and dirt but the ownership of any worthwhile minerals or petroleum in or under your land is always reserved to the Crown in Aust. If you don't agree to mining it, they can only mine below 30 metres. The local Council can regulate what you do on your land and above it, and usually does so, but generally has no ownership itself.
