I'm a LandLord and my REA contacted me saying the Tenant had been emailing them a few times now with regards to some suspected leaks from the water pipe in the rented property. Apparently the REA missed these emails, and said it went to their spam folder. The tenant after no replies for week, went and got a plumber on their own accord, and to make it worse, did it as an emergency call out. Turns out there were some issues with the pipes, which will need addressing, but by no means an emergency, and by no means should the tenant have called them out - without going through the REA. Now the REA is asking me if I would pay for the call out. When I stated - this looks like a comm issue between tenant and REA and should be resolved between them (and not me), the reply was that the REA had advised these things needs go through them, the tenant now understands it should go through them, but again askes me if I am OK to pay the invoice (emergency callout). I don't think i should be paying for the emergency call out rate (maybe for a normal call out rate given there was some plumbing issues), but to my mind I don't believe I should have to pay for the additional charges associated with 'emergency after hours call out fee' What are your thoughts here? Is it still my responsiblity and I need to cover all the cost here including emergency call out fee? Is the REA's at least responsibility, if they missed the emails, leaving the tenant to take action as they not received replies Is it for the Tenant as they made the call without authority? LL, Tenant or REA? 2Jul 21, 2022 6:25 pm Spam filters only filter out stuff that looks like spam, not email from clients they've likley comunicated by email with before. Looks like they missed it and are making up excuses. Also why didn't the tenant ring the REA after no reply. I agree it doesn't sound like an emergency and I would t be paying the emergency rate. I'd be paying the normal obligated cost you need to and have the REA foot the difference. LL, Tenant or REA? 3Jul 21, 2022 6:29 pm I cannot blame the tenant at all - they tried multiple times to contact the REA and got nowhere and then did the responsible thing in order to protect their belongings and your property. They werent to know whether it was an emergency or not, because you cant know the source of the water leaking until its investigated. You have no idea what damage is being done behind walls. If anyone holds some blame its the REA for missing emails and it should probably be worked out between you and the REA. Perhaps you could pay the normal rate, and the REA cover the difference.
