Browse Forums General Discussion 1 Oct 20, 2014 7:14 pm HI all, I'm hoping someone can help me. I built a house under owner builder license and I sold it two years ago. I recently received a call from the new owners claiming one of the structural beam in one section of the house is deflecting by 10-15mm due to too much roof weight on it. He also advised me in writing he sent his carpenter to do some work in the roof area to fix the added pressure on the window/door below due to this incorrect beam. He never called me and or asked for authorization to do this work. Question1, Did he void the statutory structural home owner warranty that comes standard with all major building works by carrying out this unauthorized work? Question 2- Can I simply send the carpenter to remediate/fix the issue by using best and cheapest method that will meet the guidelines and is compliant? or can he demand to have the beam replaced all together? if he can make this demand the job becomes much bigger and very expensive thanks in advance Re: statutory 7 yr structural warranty void question 3Oct 21, 2014 9:45 pm Can't someone just answer this question, owner builder never States you to be a building law expert, that's why its a specialist job ,so please no backside type answers, the guys trying to do right thing. Re: statutory 7 yr structural warranty void question 4Oct 22, 2014 7:41 am While accepting Joker's point I can see qebtel's point. Surely this is set down in any warranty agreement ? Are you meant to approach builder first ? Lessons for all here. Re: statutory 7 yr structural warranty void question 5Oct 22, 2014 7:52 am sh0sainy I would be looking at it and if indeed the wrong beam was installed than take responsibility for it. If the work that new owner done has caused the problem them put the responsibility back on him. Then you need to work out why your building surveyor passed the frame and then put the cost back onto him. Re: statutory 7 yr structural warranty void question 6Oct 22, 2014 12:43 pm qebtel Q1. you're the warranty provider, why dont you know?. Statutory warranty is not the same as a warranty provided by the builder. Statutory is ingrained in consumer law and has many nuances to it. Its a fair question Creator of superduperonium, expert at expert things, nobel laureate, can hold my breath for 10 minutes. Re: statutory 7 yr structural warranty void question 7Nov 10, 2014 8:35 pm I guess this begs the question "did you design the beam size"..here in WA all beam designs need to be designed by engineers so in which case you would go back to the engineer and seek recourse? The new ownwer is entitled to have the repair done properly and I pretty sure if it wasnt designed properly then you will foot the full repair bill...more onfo required Designer,Engineer (Civil,Const & Envir),Builder,Concrete & Masonry Contract.Struct Repairs Not sure if that works? I was told the issue is the headspace clearance requirement on step 4. My builder is proposing shifting the beam 310mm towards the kitchen...I'm… 2 2640 To me, that's what it looks like: poor backfilling and/or compaction. The width is about 1000mm maybe. That conduit in the photo is for the NBN. The water is about… 4 8049 |
