There is so much business that if they lose a few customers before building starts maybe they don't care. Sadly a lot of uninformed customers are paying for stages before they legally need to, and accepting substandard quality. Almost everyone I've talked to regardless of builder has been requested to pay for frame before the building surveyor has issued approval. Has anyone gotten so disgruntled with problems during the builld that they have issued the builder with a notice to terminate due to breach of contract, or has the BACV/ VCAT path been a better option? Basically, we got quoted a provisional sum of $1500 in the contract for the site costs and now, with a variation is $9904. Which is not acceptable. They don't seem to want to respond, nor do they want to sort it out and it has been over 2 months since we initially raised our concerns. We just want it fixed and we found this the only way. Hoping they would be able to sort out our problems. Basically, we got quoted a provisional sum of $1500 in the contract for the site costs and now, with a variation is $9904. Which is not acceptable. They don't seem to want to respond, nor do they want to sort it out and it has been over 2 months since we initially raised our concerns. We just want it fixed and we found this the only way. Its going to be interesting to see how it pans out. Im surprised BACV said to submit an application. A provisional sum is just that, provisional, could be more could be less. I hope you get what your after. BACV were very supportive, and while it may be provisional, they are still only allowed to charge a 'reasonable' amount over what they quoted. When the builder found out that we had submitted an application, they came back with an offer that was significantly in our favour, so I guess we won! And I have been reading your posts with very wide eyes indeed, and have been impressed with the advice and support all are offering to each other. Defiantly getting a building inspection 3-4 times and will be vigilant in documentation and records. Fingers crossed all goes well Re: Simonds Homes problems 291Jun 11, 2010 12:51 pm Hi apples, I'm building with Simonds and a note of advise is to really go through the plans - and final contract in detail - they will want you to sign on the spot w/out you taking home the plans beforehand and it is their standard ( what they tell me) but they do have a 5 day cooling period - so, during that time, make sure all is good. I agree that their customer service is totally crap and talking to them make me want to pull my hair out every time. Anyway, I was worried about this before but managed to let it go pass me thinking it must be part of building. I had to pay an extra $9000 because my soil test was apparently classified as P. I went to see the land when they said they had done the soil test and the land was untouched. How exactly are soil test being done? When I asked for a report, they sent me a report with the proper dates. What are the chances that they pull a scam on this? If you didn't see last Friday night's program, go to the Today Tonight website and view the video titled "Demolished Dreams". Already, Henley have been named and shamed and due to Today Tonight's involvement, Henley have agreed to reinstate a collapsed ceiling in a home less than 10 years old. The owners had been trying to achieve rectification for a considerable time but without result. Does this sound familiar? Today Tonight have invited any consumers who are experiencing building issues to report to them via their website advising details of problems and the builder. This media involvement could be the opportunity we need to have Simonds face up and rectify the problems they have created for us all. BACV provide very little assistance (if any) and the governing industry authority could not care less about the substandard works these builders are providing, so media awareness may be the action that is needed to bring about the justice that is required. It would be interesting for other members to know how many reports to Today Tonight may be made, so a post on HOF would keep us all informed. I was disappointed I had to pay extra for certain items eg towel racks, toilet roll holders, capet and wooden floors.
