Got a not so happy message from Simonds today. They were about to do site cut today only to be turned away by developer saying they are still waiting a final sign-off from council. Now Simonds have moved start date to 11/11.

This is really getting frustrating. Had to go back to the solicitor and she confirmed that developer has no right to stop me or builder from using the land.

oh Marshall, i want to strangle someone's neck at the moment. i even called council to check what the problem is, which they said they could not see any on records that would prevent us from starting. The only issue they could think of was the road access which the maintenance is not yet with council. so technically its still with builder and they don't want to take the risk! Grrrr!




Will yours be the first to be built on your street? I can only imagine how you must be feeling, all that build up and anticipation.. grr indeed!!

well they mentioned today that they have turned away a couple of builders already. it must be a race when they finally give the go signal

That's frustrating Horse! I am not an expert but my understanding is if the land is settled as a owner you have all the rights (within the covenant) to do whatever you want...

That is what my solicitor told me. and she has reviewed the contract and nothing in the documention would stop me from entering the land. she contacted the sellers solicitor and we will see the outcome tom.

i did some research and i am guessing it has to do with the on and off maintenance that needs approval from council.

what is annoying is in every delay in start would equate to additional rent on my part. and simonds has given me a fixed price until oct 31...

Developer Saga....

Demand letter was issued today. My solicitor gave them only until Monday to take the fence down coz legally they are already trespassing. Developer responded saying they will take down the fence today and will send pictures as evidence. However, as of this hour, I haven't received any. So tomorrow, off to site and do some inspection.
