I wanted to share my experience with you all on this. Basically, I flat out refused to pay a late fee and ended up negotiating it. I ended up paying $4k for about 9months extension. I did have to threaten to pull out though and owner build it myself and then they agreed to negotiate. At one point they said to me, why would I cancel over a few grand in extension fees. I laughed and said, why would you risk the $150k profit you'll make on my house over a few grand! The issue I have is that the late fees are not a genuine representation of the additional costs they have to incur for the build. Each quarter the Aust Bureau of Statistics publishes inflation figures for a number of things. The cost to build a house is one of them, and it is measured for each Capital city. When I last looked, the building inflation had only for Sydney had only increased by 0.25% for a quarter (not month). So if you apply that to your contract price you'll find that it's no where near the $4k a month they're claiming. Incidentally if you were to custom build or architect build, most contracts will increase in price having regard to the rate of inflation above and not by some arbitrary table they have invented. Finally, it is my view that the extension charges are not a like for like comparison. If you sign today for example, the inclusions in NSW are SMEG appliances, with a $15k credit to spend at Studio M for a fee of $5k (which I have been told you can easily get waived if you push the sales person). When I signed, it was Tecknika or Elba appliances and no $15k credit. In my view it seems they are using the extension fee to offset the cost of the promotions on offer so they can boost house sales rather than using that money to genuinely pay trades for your build. It's all supply and demand. Nothings gonna change unless all off a sudden everyone decides to not build and they can't get customers. That doesn't seem likely since they don't even have a enough tradies to keep most people happy with no delays. Thx SM gave me the choice. He recommended doing it first, just because it'll be much easier cause there's lots of space for machinery to dig holes etc. Cause after the house goes up, it's gonna be tight. It's all supply and demand. Nothings gonna change unless all off a sudden everyone decides to not build and they can't get customers. That doesn't seem likely since they don't even have a enough tradies to keep most people happy with no delays. We tried to negotiate with M when we signed the contract but the little we got in discount (Studio M vouchers) are now eaten up by the fees we've had to pay in delays They now have the Price Hold Promise which gives you certainty as to what you pay after the 9th month but as Nom said, it is like heaps over inflation. Best thing to do is to negotiate an extension of a few months at the outset. We became too invested in the end, after all the Studio M selections, to threaten to back out. And if you are going through Council like we did (and not CDC) then depending of the Council, it is at least 4-5 months gone already... Ours was just for the part where the house sits on. Our backyard is now a step up and still sloping. We haven't really thought of our landscaping but thinking of getting SM to flatten the backyard, just not sure how much it will cost. I hired my own guy to do the extra work. His very cheap if you're looking for someone to do the work. Cash jobs are his specialty, I just pay him by the hour.
