Browse Forums Building A New House 1 May 25, 2016 7:49 pm HI there, Were have had a very drawn out process with MOjo homes, we were supposed to start construction next week however i just receievd a phone call from our customer liason rep to say "management" have reviewd our file and noticed our tender had expired and since then our house base price has risen 40k. We were promised that we would not recieve any price rises and in fact our contact was signed after the tender had expired and no mention of an increase then. This seems so unethical to me. They "kindly" said we wouldnt have to wear the whole 40K(wtf) just looking for any advice here and others expereinces? Re: Mojo Homes expired tender 2May 25, 2016 8:15 pm That's bull! If you've signed your contract for that price you do not have to pay anymore! We were looking at going with them but decided against it. So many reviews said they had lengthy delays etc. stick to your guns! Don't let them railroad you! Re: Mojo Homes expired tender 3May 25, 2016 9:22 pm Yer I've just been going over our contract. It clearly says in black and white the cost of the build, it's says it can only go up for specific reason and an increase in the base rate is not one of them. Re: Mojo Homes expired tender 4May 25, 2016 9:38 pm The amount specified in your contract is what you should have to pay, if your tender had already expired your contract you signed should of had the increased price. If your builder won't budge, tell them your taking your contract to solicitor for advice, I bet they will change their mind pretty quick! Re: Mojo Homes expired tender 5May 25, 2016 9:46 pm Yep I'm starting think they f**ked up and only just realised so trying it on now! Mojo Homes expired tender 6May 26, 2016 12:05 am Wow......I'm building with Fowler Homes and without even asking they did a variation on my tender to extend the expiry date as there were some delays on my end and their end. Mind you, they extended it twice and never changed the contract price that I had signed off on. Was the delay at your end or theirs? Rawson did exactly the same thing with my friends and raised their contract price because it expired and they told Rawson that they would not pay the price rise and Rawson then said they would not build their house and let them walk.....couldn't believe it.......they let $400K slip by for a $30K price rise. These project builders are so busy that they don't care if they let people go. Good luck and choose your next step carefully. Re: Mojo Homes expired tender 8May 26, 2016 9:35 am We also had a disappointing experience with Mojo. We signed up late last year. Since then the communication has been poor and it has been quite difficult to reach CLO. In our case the CLO left the company and the new CLO has not responded to my emails for over 4 weeks. The plans haven't been submitted to council yet. My neighbor who signed up with Clarendon around the same time as us, have already got their slab laid. So we have decided not to waste our time and money with Mojo. Mojo Homes expired tender 9May 26, 2016 9:45 am deejay08 That's disgusting Rayges! Hope your friend found a better company to build with! Yeah Deejay they did go with another builder, wouldn't say better but they are now finished and happy on what they've got. In saying this, my friends were waiting on their land to be registered and hadn't signed off on the final contract, they were only expired by 2 weeks when Rawson did that to them. Amanda - definitely stick to your guns as you did sign the final contract tender and agreed with the price that's stated, they can't just change pricing, but they can put in a post contract variation to extend the date, like Fowler Homes did with me. Re: Mojo Homes expired tender 10May 26, 2016 9:51 am Glad it worked out for them...our land was delayed too but and the tender expired but the builder didn't up our price. Thank god! They've been very good so far! Let us know how you go Amanda! Re: Mojo Homes expired tender 11May 26, 2016 11:16 am HomeTweetHome We also had a disappointing experience with Mojo. They have really been terrible at returning phones calls/emails etc. the delays have all been on their behalf as they seem terribly understaffed and unorganised. We have had our appoinments changes numerous times. I showed them loyalty through all their stuff arounds and then thay have tried this on us. i wont be recommending them so far on what i ahve seen. Our land was registered the same time as our neighbours and they are all in in their homes already Re: Mojo Homes expired tender 12May 26, 2016 12:38 pm I would be asking them to provide evidence of where you have held up the process. If you haven't already, make a timeline of when everything happened so you can easily show that this is THEIR fault not yours. Also if you have signed the contract with the old price, I really don't think they have a leg to stand on! Demand to speak to someone higher! Similar to our situation, our tender is due to expire this month (180 day tender). Land registration took longer then expected, then settlement another 3 weeks, it added up. So I took the liberty of contacting my consultant and had tender re-dated from October, right before their price increase. So we have till end of April to go to site, which wont be a problem. Re: Mojo Homes expired tender 15Mar 20, 2017 2:51 pm I have posted in "Product review com au" our horrendous experience with Mojo Homes called 'Enigma 41 - paperwork still going'. Please have a read and consider your options. Re: Mojo Homes expired tender 16Mar 20, 2017 5:45 pm Run while you can by the sound of things. Tell them you have a legally binding contract for a fixed price, and apart from where stipulated in the contract (e.g. provisional sum items) you won't be paying a cent more. If they argue, get a lawyer. If you don't want to proceed with them, tell them to give you a full refund of your deposit and you'll go elsewhere. Slimy.. Do get legal advice XD I'm just a gobsmacked well meaning random person..
