Post subject:  Certificate of occupancy

Hi just looking for some advice. We started to build a house in Melbourne a few years ago when living in Brisbane. The building work took a long time mainly as we were in no hurry. The builder told us that the house would be ready so we moved down, were given the keys and moved into our home. No final inspection was carried out, no certificate of occupancy has been issued and he hasnt asked for his final payment or the variances and we've been in here 6 months! There are a few things not here like the rain water tanks and the motor for the garage door. Legally do we have a leg to stand on if things go wrong? Any comments would be appreciated thanks.

technically moving into a house that doesnt have a Cert of Occ is illegal.
Also any insurance you have on the house is automatically void.

so what do we do now? the builder is not interested...maybe he is waiting for the specs to be paid? thats $6000 but surely he would be at least giving us invoices? Also is it possible to get the cert of occ by ourselves? Thanks for the advise completely in the dark here :)

not too sure what happens here. However do you have a name of the orignal surveyor who has done the other three inspections???
I would try getting onto him. Or maybe seek the advice of a professional for your region, ie building commision or HIA etc.

I've found them very helpful- and they don't just side with the builders!

thanks Anthea i will try those guy tomorrow or monday haha....i'm not stressed...i would have been happy living here like this if only the other half talked about him may having work in india! oh and also the black saturday bush fires reached about 2km from the house so the fact that my insurance may be void makes me want to drink LOL
