Browse Forums Building A New House 1 Mar 13, 2022 11:24 am Does anyone knows what I should do if part of the retaining wall has been removed by our neighbor and the soil had fallen and pressed on our wall? And what I can do to prevent them to do the same thing in the future. Re: Retaining wall removed by our neighbour 2Mar 14, 2022 12:52 pm Need a little bit more info: Is the retaining wall on their property? your Property? on right on the boundary of both? Is your neighbour doing a new build? or some sort of reno? Need to know why the wall was touched in the first place. Have you spoken to your neighbour at all? What did they say? Take plenty of pictures of the area in question as it will no doubt come in handy in future discussions over remediation. Hi there, The retaining wall is within our property and 20cm away from the boundary. Yes, both of us are doing a new build. I have spoken to them and they said don't worry, they will build the new one on the boundary. It's rediculous right? And then I think because our builder had send them an email they changed and said that the retaining wall fell when they did the excavation and they would fit it. My question now is what could I do to stop them to build their retaining wall on the boundary. I have seen their floorplan and know they would build the retaining wall right on the boundary. I worry they would do the damage to our retaining wall. I have asked for council, but they said I cann't againt them to do so if they pay for it. But the truth if the two retaining walls are too council, doesn't the council would consider this point? I just cann't believe that the builder would do such thing and think it's too rediculous. Re: Retaining wall removed by our neighbour 4Mar 18, 2022 10:44 am The requirements of retaining walls differ from council to council, however given the wall was already in place, and on your property, then that's where the wall should be rebuilt (to the same standard that was there originally). The expense should also be upon the builder that caused the damage. If they do indeed build a new wall right on the boundary then that's not such a bad thing because you will get <>200mm more space on your block. Moving the wall by 200mm might sound like a small thing, but some councils are very pedantic about retaining walls in relation buildings and boundarys. One tip - Don't assume the builder next door cares about you or the wall. You aren't his client and you aren't paying him. Thank you again Simeon.. I will call my certifier for that. Have a good day 4 6114 Not sure what council area you are in. Some LGA's allow zero lot retaining walls. This usually occurs in greenfield developments but not often in established areas.
