I still worry about the scratching with timber. The house we're in now has terrible scratching and you can feel where it's lifting at the joins under foot and it's still fairly new I think (rental). I've since found out that our HN doesn't have flooring too. He's quote us $140k more than what we've signed up for, what a rip off. Not to mention its taken him oh I don't know 3-4 months to come up with such a ridiculous quote with no details of what we'd be paying for! We went to a kitchen place under his instruction about 2 months ago and where waiting on the guy there to call with a suitable time (wasn't there the first time) and never heard from him so I can only guess what kind of kitchen he has quoted on. I feel sorry for all those that have been sucked in by him and have used his services. What a rip off! Photos added.... 34Aug 22, 2012 1:37 pm Yep I am glad to say that was the first and last time I've ever been sun burnt like that! I think it was my first day of the session out in a singlet. Blocks in a perfect spot, only 3kms from my daugthers school too which is one of the best in the area and the neighbours we've meet soo far seem pretty good except for the developer that lives in the ugly house over our back fence that's refusing to pay for our side fence (RHS in pics). There should be a fence from the RHS of our driveway all the way up to the back of the block - it's about 64m in total. See pic below - red line shows where the fence should be. I think half the problem was that we agreed to pay for his section of the back half which was only about 20m (so we could get moving with it) so now he's just expecting us to pay for the rest when the agreement was that he would help with the side fence. We've had all types of excuses since eg.. only want rural fencing - agreed to him paying half of the cost of rural fencing then he tells us the lands sold so ask new own in 30 days - 6 months later it's still in his name... argh the joys of neighbours. Not sure what we'll do as we're hoping to be in by the end of the year and I can't see this being solved in a hurry. If so, did you have a clause re: fencing in your contract? He seems to like knocking on our door at 9 at night to discuss it, now that we've moved hopefully it will stop the late night visits. There was no clause in the contract and I don't really want to take it to a small claims court but not sure what the answer is?? Photos added.... 38Aug 23, 2012 11:08 am Thanks Dee, Council weren't much help, apparentely Magistrates court is the next step but I did find out that he has to disclosure the notice to fence in his S32 as a notice of an impending liability so I thought I'd send him this last notice to fence - Following on from our previous letters, dates listed below, we are writing to you in accordance with the Fences Act 1968 in relation to the fencing of our adjoining properties,(address) Refer to letters dated -(4 dates) Type of fence proposed - Colourbond Panel Fence in Woodland Grey (to match exsiting) Total length of boundaries - 63.5m Total cost - $$ Of which we propose a 50/50 split of $$$$ Please note that under the Fences Act 1968 and Sale of Land Act 1962 you are required to disclosure this notice to fence within the Section 32 statement provided to perspective purchases as notice of an impending liability. Please return the attached form with payment within 14 days to allow commencement of construction and to avoid any further action being taken. What do you think? Photos added.... 39Aug 23, 2012 2:48 pm Hi Jem, Most people aren't aware but Community Legal Centres offer free advice clinics in many areas. The clinics are ideal for a little bit of "point me in the right direction" type of legal advice and often the lawyer that you see will be happy to look over a letter for you to make sure you are on the right track. Here's the CLC website http://www.communitylaw.org.au/ - they have a search function so you can find one close to whereever you live. Alternately have a look at the website of legal aid http://www.legalaid.vic.gov.au/ which may have some useful resources. Just from a cursory glance at your proposed letter I would comment that you should say "disclose" not "disclosure" and also "prospective purchasers" instead of "perspective purchases". Maybe you should actually send your neighbour a quote from the fencing company (if you have one). Hope that helps Re: Jem's custom build - our journey!
